The best way to talk about it is to look at a case from the Mississippi Supreme Court called Richard v. Richard.

The Mississippi Supreme Court said that habitual cruel and inhuman treatment means something more than unkindness or rudeness or mere incompatibility.

You’ve got to show that your spouse did something that endangered your life, limbs or health or your spouse did something that created a reasonable fear of this type of danger.

Otherwise, you’ve got to show that the conduct your spouse did is so unnatural it made the marriage revolting and made it impossible for you to act as a normal spouse would.

So, in Richard v. Richard, this married couple went to court to get a divorce.
The testimony and evidence showed that Deborah Richard sat in front of the television set all day long watching the “home shopping” network and bought a bunch of stuff when she watched this show.
She ran up large telephone bills, including one call to the “psychic friends” network for $500 for a single call.
The telephone company eventually disconnected the telephone.
In an effort to keep up with the bills, Everett Richard worked two jobs, paid Deborah $500 every two weeks, made the second mortgage payment on the house of $350, paid Deborah’s car note, and paid off a signature loan at the credit union made to Deborah.
But, Deborah’s expenses far exceeded Everett’s ability to provide.
Stupidly, Deborah did not make the first mortgage payment on the house during the separation, and at the time of the divorce hearing, the house had been foreclosed.
The purchaser was in the process of beginning eviction proceedings.
Even more stupidly, periodically Deborah would hit Everett and he would hit her.
And just as dumb, Deborah would accuse Everett of molesting their 14 year old daughter and this wasn’t true.
In the past, the Mississippi Supreme Court would require a specific act caused the separation before a divorce may be granted on grounds of habitual cruel and inhuman treatment.
In this Richard v Richard case, the Court said it can now be habitual or continuous behavior over a period of time, close in time to the separation, or continuing after a separation occurs, that may satisfy the grounds for divorce.
So, the Court granted Everett a divorce on the grounds of habitual cruel and inhuman treatment.
