Navigating The World Of Divorce

There’s something unique about the work that divorce lawyers do for their clients.

It has to do with something as sensitive and personal as family law, combined with the legal apparatus of the justice system…

For anybody who has not seen it up close, the justice system is not particularly warm, fuzzy, or personal.

It’s a set of rules attached to a bureaucracy that has even more rules. At least, that’s one way to describe it.

But then living, breathing human people have to navigate the system!

How do they do that? First and foremost, they need qualified and attentive representation. They need a lawyer who understands what they are up against, not just legally – but emotionally! Skipping this component often leads to confusion and worse.

Custody and More

When you’re dealing with family law, you’re often dealing with the things that are most important to people in their lives.

You’re often trying to figure out visitation for two parents who love their children “fiercely,” as one of our clients put it a while ago. Each parent is not going to give up – why would they? So there’s an essential conflict that has to be ironed out.

You’re also working with people’s money and their livelihoods as they try to figure out how to support a family equitably. That can turn into quite an intractable argument – and then the lawyers get involved. Well, they get more involved.

Legal Entanglement

Looking back through the blog, you’ll see some examples of this idea at work. People get into a stew trying to solve a family law case. They take the wrong path, and getting back on track takes a lot of time and effort.

For example, we talk about the contempt issue, where someone antagonizes a court partly because they don’t understand their responsibilities and feel that they are unfairly prosecuted.

There’s often a disconnect here too – for example, the party who is paying for child support might feel like they’re being controlled by the other counterparty, not necessarily the legal system.

They may forget that there is a judge at the other end of that order.

So then they start messing around and end up in a much worse situation.

Meanwhile, the court is ‘counting beans’ – analyzing the numbers, calculating need versus earnings, and making its pronouncements accordingly, without considering people’s feelings, to an extent.

The representative has to be that link between the court and the people!

In most cases, no one else is going to do it.

So think about this in the context of family law and how to preserve your rights under the law.
